Someone who is not a member of the United States wants to come work here. This page gives an overview of the types of nonimmigrant and immigrant visas that can be used for work, as well as other types of noncitizens who can get work permission. There is a link in each classification to more information about the standards for that classification. An company will often file a petition with USCIS on your behalf if they want to hire you temporarily as a nonimmigrant living in the United States. The main types of temporary nonimmigrant workers are explained on the Temporary (Nonimmigrant) Workers page. If you have the right skills, schooling, and/or work experience, you might be able to get an employment-based immigrant visa and live and work in the United States permanently.
It is usually necessary to get a visa from the U.S.
Department of State (DOS) if you live outside of the U.S. and want to work here, unless people from your home country don't need visas. To find out more, go to DOS's Travel Without a Visa page. A lot of the time, USCIS has to accept your petition before you can apply for a visa at DOS or try to get in at a port of entry. In order to enter the United States, you must first show yourself to a U.S. Customs and Border Protection (CBP) officer and get permission to do what you want to do. You can usually apply for the following if you are in the United States legally as a nonimmigrant but don't have permission to work: A change of status to a nonimmigrant category that lets the person work; or Changing your position so that you can live in the country legally permanently. This can be filed at the same time as an immigrant visa petition, or based on the situation, the person applying may need to get an approved immigrant visa first before they can apply for an adjustment of status to become a legal permanent resident. Your change or adjustment of status application may need a U.S. employer or other qualified requestor to make an application or petition on your behalf to show that you are eligible before we can approve it. This depends on the classification you want. But if you apply based on certain categories, like as an alien with extraordinary ability or as a nonimmigrant E-1 or E-2 main treaty trader or investor, you may be able to self-petition, which means that someone else files the application for you. You can also file Form I-765, Application for Employment Authorization, to ask for work authorization and an Employment Authorization Document (EAD) if you are in the United States. This includes if you are applying for permanent residence or are a certain family member of an alien who has lawful nonimmigrant status. You can also apply for an EAD that shows that you are allowed to work in the United States if your legal status lets you do so.
What you need to do to stay in the United States and how long you can work here depend on the legal status the Department of Homeland Security (DHS) gives you
It is important that you follow all the rules that came with your work permit and your entry into this country. You could be kicked out of the United States or not be able to come back if you break any of the rules. If you work for a business:
1) If they give their technical skills to a Brazilian company, they can get a business visa that lets them work in Brazil and get paid in their home country.
2) You can set up a company in Brazil and get an Administrator's Visa if your company wants to do business there. This is a permanent resident visa, and your business must invest at least R$150k in order to hire 10 Brazilians over the next two years, or R$600k all at once.
If you don't have a job:
3) Look for a job in Brazil. You must have a job offer with a pay that is at least as high as your salary in your home country in order to get a Temporary Work Visa. The visa is good for two years, and after that, you can apply for a permanent passport.
4) Start a business in Brazil and put money into it. For an Investor's Visa, you need to spend R$150,000 with the plan to hire 10 Brazilians over the next two years, or R$600,000. It is possible to spend this money in real estate as long as it is marked as capital. The visa lets the person live there permanently.
It takes 30 to 60 days for all visas to come through
Keep in mind that each of these cards is tied to a certain business. If you switch jobs, you'll need a new passport. You can apply for the visa on your own, but if you need it quickly, you can hire a company that only gets visas. I have seen people marry a Brazilian as an alternative, but it takes a long time to get the papers (very formal), so it's surely not a quick fix.
1) If you are not from Brazil, it is hard to find work there, so I would not suggest that you come here to look for work. If you live outside of Brazil, how can I best find a job there?
